PROJECT: Ponca Hills Airborne Infection Isolation Renovation

TO: Qualified General Contractors
THIS IS NOT A CHANGE ORDER NOR A DIRECTION TO PROCEED WITH THE WORK DESCRIBED HEREIN.

Invitation for Bids for an Airborne Infection Isolation (AII) Addition at the Ponca Hills Health and Wellness Center located in Norfolk, Nebraska.

The Ponca Tribe of Nebraska (PTN), Health Services Division will be accepting sealed bids for construction of an Airborne Infection Isolation Room at the Ponca Hills Health and Wellness Center. The addition will include the following: Isolation/Exam Room, Restroom, Storage Room, Donning and Doffing Areas. Bids received will be opened and qualified by the Ponca Tribe of Nebraska on October 22, 2021 at 4 pm CST no late bids will be accepted

A mandatory pre-bid site visit will be held September 30th at 12:00 pm, CST

General Notes:

  1. It is the Contractor’s responsibility to identify any and all discrepancies in the scope of work, not meeting Industry Standards or that which is inconsistent with the International Building Code (IBC), and Project design documents.
  2. All electrical wiring, apparatus and equipment for electric light, heat and power, technology circuits or systems shall comply with the International Building Code, International Mechanical Code, International Plumbing Code, International Fire Code, 2019 NFPA 13, rules of the Department of Commerce or the Department of Labor, and environmental laws, as applicable, and be installed in conformity with accepted standards of construction for safety to life and property.
  3. Contractor must reconnect all utilities, service panel or service feed. Also includes gas, propane. Include such equipment or materials identified in the pre-bid conference.
  4. Contractor will secure all permits and fees.
  5. Contractor is responsible for a thorough investigation of the scope of work.
  6. Contractor will repair any damage to the property or structure created by the scope of work.
  7. Contractor shall be responsible for all debris removal related to all work performed under this work scope.
  8. PTN reserves the right to approve any and all subcontractors. No subcontractor may be used that has been suspended, debarred, or otherwise excluded from participation in any federally funded program or by the PTN.

NO WORK SHALL BE PERFORMED UNTIL ALL REQUIRED PERMITS HAVE BEEN ISSUED AND COPIES IN THE POSSESSION OF THE PROJECT COORDINATOR AND /OR PONCA TRIBE OF NEBRASKA BUILDING OFFICIAL.

PONCA TRIBE of NEBRASKA WILL, TO THE GREATEST EXTENT FEASIBLE, GIVE PREFERENCE IN THE AWARD OF CONTRACT TO INDIAN ORGANIZATIONS AND INDIAN-OWNED ECONOMIC ENTERPRISES.

THE CONTRACT WILL BE AWARDED TO THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER AS DETERMINED BY THE PURCHASING AGENT, SUBJECT TO INDIAN PREFERENCE.

Work Scope Description:

  1. Airborne Infection Isolation (AII) environments control the air flow in the room and reduce the level of infectious particles using negative air pressure, high air volume, HEPA filtration, and 100% exhaust. It should mitigate both airborne and contact transmission when treating patients with highly infectious diseases.
  2. Bids must be honored for 90 calendar days.
  3. Contractor shall be responsible for connections to utilities. Electric, Well and Septic and all costs associated. All utilities shall be the Contractor’s responsibility until the building is officially turned over to the Ponca Tribe of Nebraska (certificate of occupancy and punch list completion).
  4. Refer to the Project bid form for the listing of Bid Alternates.
  5. All sales of construction-related services to PTN where the gross amount paid to the selected firm exceeds $10,000.00 is subject to Tribal services tax at the rate of seven percent (7%). Contractor shall be responsible for charging, collecting, and remitting any applicable Tribal taxes to the Ponca Tribe of Nebraska Tax Commission, including the filing of required tax returns. If a bidder includes any taxes in its response, including PTN taxes, the taxes must be separately stated and identified.

Mobilization:

  1. The Contractor shall be capable of mobilizing their equipment and crews within seven days of the receipt of Notice to Proceed.
  2. Contractor shall submit building schedule to project manager at the time of contract signature by the Contractor.
  3. Contractor shall provide means and methods for all building phases of construction.

PROJECT MANAGEMENT RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS FOR ANY REASON.

Bidding notes:

  1. Submit bid in lump sum (supply and install), not to exceed amount. Cost plus a percentage of cost is prohibited and will not be allowed or accepted.
  2. All Contractors must provide the following along with their bid submittal:
    a. Completed and signed Construction Bid Form (See Attachment A, Application)
    b. A copy of Current PTN Vendor’s License (or a copy of the submitted application)
    c. A copy of Current Insurance Certificate
    d. Bid Bond in an amount not less than five percent (5%) of the bid amount
    e. A copy of Authorized Signature Sheet (submitted with first bid submittal)
  3. Contractor must show experience with similar projects of the same construction types to be considered for qualification.

**Please note that the bids must be submitted via mail to the P.O. Box. FedEx and UPS will not deliver to a P.O. Box. Please plan accordingly to ensure the timely receipt of your bid submittal.

BIDS NOT SUBMITTED IN THIS MANNER WILL BE REJECTED.

Licensing:

  1. Firms must be a registered licensed contractor within the State of Nebraska. A copy of this license must accompany each bid.

Permit and Contractor Requirements:

Permits: Contractors are responsible to attain all necessary permits for all work, including Ponca Tribe of Nebraska (PTN) Permits.

Bonding & Insurance Requirements:

  1. Bonding is required. A performance bond int the amount of one hundred (100%) percent of the total contract price is required. A performance bond requirement is to ensure that, if a contractor defaults, the Ponca Tribe of Nebraska may request that the surety pay the expense incurred to complete the construction contract.
  2. In addition, a payment bond equal to one hundred percent (100%) of the contract price to ensure subcontractors/suppliers are paid is required. The payment bond must contain language stating that if the contractor fails to make a payment to its subcontractors/suppliers, the surety will make the necessary payment.
  3. If a warranty or maintenance bond is not provided, payment will be subject to a five percent (5%) warranty retainage which will be held until the expiration of the warranty period.
  4. Comprehensive general liability of at least $1,000,000.00, commercial auto liability of at least $1,000,000.00, worker’s compensation in amounts required by Ponca Tribe of Nebraska Code Title VII and Nebraska state law, employer’s liability of at least $1,000,000.00, and umbrella liability of at least $10,000.00 are required.

Miscellaneous:

  1. All bidders are responsible for costs incurred in submitting their bids. PTN will not provide reimbursement for any costs incurred by any and all firms in connection with this process.
  2. All materials submitted regarding this IFB shall become and remain property of PTN and will not be returned to the bidder. PTN has no obligation to return any bids received in response to this IFB.
  3. No additions or changes to any response will be allowed after the response due date unless such modification is specifically requested by PTN.
  4. All bidders are responsible for contacting PTN to understand any Tribal and Indian preferences, including employment preferences. All bidders are responsible for determining any Tribal laws that may affect the Scope of Work for this project. The Ponca Tribe of Nebraska Code is publicly available on the PTN’s website for bidders to review.
  5. PTN reserves the right to reject any or all bids and to waive all informalities and minor irregularities in receiving bids. PTN reserves the right to accept, reject, or negotiate specifics of any bid. A bid does not constitute a binding contract, such contract to be separately entered into by the selected firm and PTN.
  6. Nothing in any awarded contractor or this IFB shall be read or construed to effect, modify, limit, or waive the sovereign rights or authority, including immunities, of PTN or its departments, agencies, instrumentalities, officers, agents, and/or employees.
  7. In providing services and while present within the territory of the PTN, the selected bidder and its employees shall comply with all provisions of the laws of the PTN, including but not limited to the Ponca Tribe of Nebraska Code, and applicable federal laws.
  8. Responses from individuals or firms suspended, debarred, or otherwise excluded from participation in any federally funded program or by the PTN will be rejected.
  9. All documents and works of authorship prepared in performance of the project shall be the property of the PTN. PTN will not claim ownership, right, or title to any standard documents or materials used generally in the selected bidder’s work and not prepared in the performance of the services for PTN.
  10. The awarded contract is and shall be considered to be entered into and performed within the jurisdiction and territory of the PTN. The awarded contract shall be governed by and construed in accordance with the laws of the PTN.
