LAW AND ORDER CODE REVISION

The Ponca Tribal Council will be reviewing proposed amendments to the Law and Order Code. The revisions are being considered because the Tribal Council wants to increase the autonomy of the Tax Commission by changing the composition of the Commission and granting the Commission the authority to determine whether or not a commissioner should participate in an action due to a potential conflict of interest.

There are changes being proposed to Title XII. The revisions being considered include but are not limited to the following:

  • Section 12-2-2 Changes the composition of the Commission by removing the Vice-Chair of the Tribal Council and increases the number of Tribal members who serve
  • Section 12-2-3 Changes the qualification of the Commission
  • Section 12-2-8 Requires the Commission to elect a Chairperson and Secretary at its first meeting each calendar year or earlier if a vacancy occurs, and prohibits Chairperson from voting unless there is a tie
  • Section 12-2-10 Gives the Commission the authority to determine by majority vote whether a Commissioner is able to participate in an action due to a potential conflict of interest.

There will be a discussion by Tribal Council that is open for public comment on August 6, 2024, at 4:00 p.m. or as soon thereafter as it may be heard.
